{"id":26290,"date":"2026-11-06T10:51:52","date_gmt":"2026-11-06T08:51:52","guid":{"rendered":"https:\/\/zawia3.com\/?p=26290"},"modified":"2026-11-06T10:51:52","modified_gmt":"2026-11-06T08:51:52","slug":"execution-safeguards","status":"publish","type":"post","link":"https:\/\/zawia3.com\/en\/execution-safeguards\/","title":{"rendered":"Egyptian Commission calls for safeguards for death row defendants in new Criminal Procedure Code"},"content":{"rendered":"<p>The Stop the Death Penalty in Egypt campaign of the Egyptian Commission for Rights and Freedoms issued on Thursday 5 November 2026 a legal <a href=\"https:\/\/www.ec-rf.net\/%d8%a7%d9%84%d9%85%d9%81%d9%88%d8%b6%d9%8a%d8%a9-%d8%a7%d9%84%d9%85%d8%b5%d8%b1%d9%8a%d8%a9-%d9%84%d9%84%d8%ad%d9%82%d9%88%d9%82-%d9%88%d8%a7%d9%84%d8%ad%d8%b1%d9%8a%d8%a7%d8%aa-%d8%aa%d8%b7%d9%84-15\/\">study<\/a> on the safeguards for defendants in death penalty cases in the new Criminal Procedure Code, Law No. 174 of 2025, which replaces Law No. 150 of 1950, and whose entry into force was postponed by Law No. 160 of 2026 to 1 October 2027.<\/p>\n<p>The study addressed remote trials, pretrial detention for crimes punishable by death, the referral of the defendant&#8217;s papers to the Mufti, which the law allows the court to rule on without waiting for his opinion, and the Court of Cassation&#8217;s review of rulings. It recommended allowing a request for retrial with a stay of execution, notifying the convicted person and his family in writing before the date of execution, postponing the execution of pregnant women, handing the body over to the family, and halting death sentences and executions as a step towards abolishing the penalty.<\/p>\n<p>The Commission said in the study that &#8220;legal protection does not begin at the moment the verdict is pronounced&#8221;, and that &#8220;compensation or retrial do not bring back to life someone on whom a wrongful sentence was carried out&#8221;.
